Receiverships and Estates Department

Family disputes often involve the need to manage family assets. This may be necessary in order to preserve and manage the assets until the court decides who is entitled to them or how they should be divided, or in order to sell the assets when required.

When family members are unable to reach an agreement regarding jointly held or family-owned assets, the court may appoint an independent professional to manage them. Israel’s Family Courts regularly appoint partners from our firm to serve in such neutral roles, including as estate administrators, receivers and guardians responsible for property and financial affairs, and in some cases for personal affairs as well.

Our broad experience in real estate, urban renewal, banking, inheritance and estates, guardianship, commercial law and family-owned businesses enables us to understand the full picture — both the complex professional and legal issues involved and the people behind the dispute.

Attorney Ayelet Tresser heads the department and works closely with the firm’s other practice areas whenever their expertise is required.

Our work in this field includes:

Estate Administration: Managing, preserving and enhancing the assets of an estate until they are distributed to the heirs; selling estate assets when necessary; representing estates in urban renewal projects; arranging the transfer to Israel of estate funds held abroad; and working with foreign lawyers to manage assets located outside Israel.

Receivership in Divorce Proceedings and Family Property Disputes: We are appointed as receivers in divorce proceedings, disputes between heirs and significant disputes involving property jointly owned by family members. Our work may include the sale of real estate and other assets, as well as the management of commercial properties or businesses.

When a business needs to be managed as part of the process, we often work together with accountants or experienced business advisers who are familiar with the relevant industry.

Guardianship of Property and Financial Affairs: We manage property and financial matters on behalf of individuals who are unable to do so themselves, always with careful attention to their interests and well-being. In some cases, this also involves legal proceedings to cancel transactions and recover assets on their behalf.
